Terms & Conditions
1. Agreement and Service Relationship:
These Terms & Conditions apply when you visit the Nest Craft Interiors website, submit a project inquiry, request an estimate, schedule a consultation, or engage us for residential renovation services. They establish the general framework for communication and project administration. Individual projects may also be governed by a separate written agreement, proposal, scope of work, or service schedule. Where a signed project document contains terms specifically applicable to your project, those project-specific terms will control to the extent of any inconsistency with these general website terms.
2. Consultations and Project Assessments:
Initial consultations are intended to help us understand your goals, property requirements, preferred finishes, anticipated scope, and scheduling expectations. Information discussed during a consultation does not by itself create a binding commitment to complete particular work. We may need to inspect the property, review measurements, examine accessible areas, discuss design selections, and identify practical requirements before preparing a final proposal. You are responsible for providing information that is accurate and reasonably complete so that our planning can be based on the conditions you have described.
3. Estimates, Proposals and Pricing:
Estimates are prepared using the information available to us at the time of preparation and are intended to describe anticipated project costs. Unless otherwise stated in writing, an estimate does not constitute an unconditional promise that the final project cost will remain unchanged. Pricing may be affected by material selections, labor requirements, site conditions, supplier pricing, requested revisions, or conditions that were not reasonably visible during an initial assessment. A written proposal or work order will identify the scope and pricing applicable to the project, and material changes will be discussed with the homeowner before proceeding whenever practical.
4. Project Scope and Client Approvals:
The services included in a project are determined by the approved scope of work. Items not specifically included should not be assumed to be part of the contract simply because they were mentioned during an informal conversation. Homeowners are expected to review plans, selections, specifications, finishes, fixtures, and other project details before providing approval. Where your decision is required to continue work, delays resulting from late selections, unavailable information, or requested revisions may affect the project schedule and related costs.
5. Materials, Products and Substitutions:
Renovation projects may include cabinets, flooring, countertops, plumbing fixtures, lighting, hardware, appliances, paint, structural materials, and other products. Availability can change due to supplier inventory, manufacturing schedules, shipping conditions, discontinuations, or other circumstances outside our direct control. If an approved product becomes unavailable, we may communicate suitable alternatives for consideration. Any material difference in cost, specification, appearance, or expected delivery will be discussed before a substitution is incorporated where approval is required. Manufacturer warranties remain subject to the applicable manufacturer's own terms.
6. Property Access and Homeowner Responsibilities:
The homeowner must provide reasonable and safe access to the areas where authorized work is scheduled. Work areas should be cleared of unnecessary personal belongings, fragile objects, valuables, and other items that could interfere with construction activity. Please notify our team of known hazards or unusual conditions, including concealed utilities, previous water intrusion, structural concerns, security systems, pets, restricted areas, or other circumstances that could affect safe project execution. Failure to provide required access or information may result in schedule adjustments.
7. Scheduling, Delays and Coordination:
Project schedules are developed according to the approved scope, workforce availability, material lead times, inspections, deliveries, and anticipated site conditions. Dates may change because of severe weather, supplier delays, inspection requirements, permit processing, concealed property conditions, client-requested changes, or the actions of independent third parties. We will make reasonable efforts to communicate significant schedule changes and coordinate the next available steps. A projected completion date should therefore be understood as a planned timeframe rather than an absolute guarantee unless expressly stated otherwise in a written agreement.
8. Change Orders and Additional Services:
Renovation conditions can require adjustments after work begins. If additional labor, materials, demolition, repair, redesign, or other services become necessary, we may prepare a written change order describing the proposed work and its financial or scheduling effect. Homeowner approval may be required before chargeable additional work proceeds, except where immediate action is reasonably necessary to address an urgent safety issue or prevent further property damage. Changes requested by the homeowner may likewise affect the agreed price, materials, sequence, and completion schedule.
9. Payment Administration:
Deposits, progress payments, milestone draws, and final balances are handled according to the payment schedule established in the applicable project agreement or work order. Payments may correspond to completed phases, approved materials, project milestones, or other agreed events. Additional work authorized through a change order may result in additional amounts becoming due according to the revised payment arrangement. Unresolved balances may affect scheduling, procurement, or continuation of work where permitted by the applicable agreement and law.
10. Completion, Inspection and Punch-List Items:
When the principal scope is substantially complete, we may conduct a walkthrough with the homeowner to review the finished work. Reasonable punch-list items or minor adjustments identified during the walkthrough may be documented and addressed according to project circumstances. Completion does not necessarily mean that every third-party delivery, manufacturer service appointment, or warranty matter has been finalized. Items outside our contracted scope remain the responsibility of the appropriate provider unless otherwise agreed in writing.
11. Workmanship and Product Warranties:
Any workmanship warranty provided by Nest Craft Interiors will be governed by the applicable written project agreement or warranty documentation. Such coverage generally relates to workmanship performed by our team and may contain specific exclusions or conditions. Products, appliances, fixtures, equipment, and materials may carry separate manufacturer warranties. Manufacturer warranty claims are subject to the manufacturer's procedures, limitations, registration requirements, and coverage terms. Damage caused by misuse, unauthorized modifications, ordinary deterioration, improper maintenance, or work performed by others may fall outside applicable workmanship coverage.
12. Safety and Worksite Conditions:
Active renovation areas may contain construction equipment, tools, temporary openings, dust, noise, stored materials, and other hazards. Homeowners, guests, children, and pets should remain away from restricted work areas unless our team has indicated that access is safe. We may temporarily limit access to portions of the property when necessary to protect people, materials, or completed work. Known hazardous conditions should be disclosed before work begins so that appropriate planning can take place.
13. Third-Party Professionals and Services:
Certain projects may involve architects, designers, engineers, inspectors, material suppliers, delivery companies, financing providers, specialty trades, or other independent professionals. Their services may be governed by separate agreements and policies. Where a third party is independently retained by the homeowner, that provider remains responsible for its own professional services and commitments. Nest Craft Interiors is not responsible for independent services beyond the responsibilities expressly assigned to us in the applicable project agreement.
14. Website Content and Responsible Use:
Website descriptions, photographs, project examples, service information, and other content are provided for general reference and may be updated as our services and operations change. Actual project results may vary based on property conditions, dimensions, materials, selections, design requirements, and other project-specific factors. Visitors must use the website lawfully and must not attempt to interfere with its operation, introduce harmful code, submit fraudulent information, or reproduce protected website materials without appropriate authorization.
15. Cancellation, Suspension and Unforeseen Circumstances:
If a homeowner needs to postpone or cancel a project, notice should be provided as early as reasonably possible. Depending on the project agreement, costs may have been incurred for ordered materials, completed design or preparation work, scheduled labor, subcontractor commitments, or other project expenses. We may also suspend work when necessary because of unsafe conditions, unavailable access, outstanding approvals, material shortages, unresolved payment issues, or circumstances outside reasonable control. Any cancellation or suspension rights will remain subject to the applicable written agreement and law.
16. General Responsibility and Updates:
Nest Craft Interiors will perform contracted services according to the applicable project agreement and will use reasonable care in carrying out its responsibilities. Nothing in these Terms & Conditions excludes a responsibility that cannot legally be excluded. We may update these general website terms periodically to reflect changes in our services, operations, or applicable requirements. The terms applicable to a specific project may also be supplemented by the written documents approved for that engagement. If you have questions about these terms, your project scope, or a proposed change, please discuss the matter with Nest Craft Interiors before proceeding.
